Japanese knotweed

Tall, bamboo-like canes along the fence or red shoots in your border can be unsettling, especially if they seem to come from next door. Knotweed can usually be managed, and the best results tend to come from neighbours working together, as treating only one side can push it back and forth. The pack includes editable example messages and a log for events and contacts.

What are the rules?

In England and Wales, it is generally not illegal to have Japanese knotweed on your land, but you must stop it spreading off your property. The courts have held that encroaching rhizomes can amount to a private nuisance, although each case depends on its own facts. Planting it or causing it to grow in the wild is an offence, and contaminated soil must be disposed of correctly. Scotland and Northern Ireland have their own rules, so check the guidance that applies.

How to approach it

1. Get the plant identified first, and talk about "a plant that may be knotweed" until you know for sure.

2. Send a short message saying what you noticed, where and when, and ask whether your neighbour would be willing to have it checked.

3. Suggest one specialist survey for both gardens and a joint treatment plan, with no digging or strimming in the meantime.

4. Keep a dated log with photos taken from your own property and agree a date to look again together.

Tips for your message

Start with curiosity rather than alarm, and avoid claims about damage or property value unless a professional has assessed them. A gentle opening such as "I spotted this by the fence, do you know what it is?" lands far better than an accusation and makes it easier to say yes.
